Washington Commanders Alleged Misconduct Investigation in the Spotlight as Sale Nears

In recent months, the controversy surrounding the Washington Commanders has ramped up as the National Football League (NFL) conducts a second investigation into alleged workplace misconduct. The ongoing investigation led by Mary Jo White has stretched for over a year, and with Dan Snyder’s proposed $6 billion sale of the team, speculation arose that the findings may never be revealed. However, NFL Commissioner Roger Goodell recently confirmed that the league is committed to releasing White’s report to the public, regardless of whether Snyder sells or keeps the team.

Second Investigation and Written Report of Findings

The NFL’s first investigation into the Washington Commanders found more than 40 women alleging sexual harassment in the workplace by colleagues including Snyder and other team executives. The investigation revealed a toxic culture that fell short of the NFL’s values, leading to Snyder being fined $10 million in July 2021. However, following Congressional testimony in February 2022, Mary Jo White was brought on for a second investigation into further allegations of misconduct.

As part of the ongoing investigation, White will provide a written report of findings after nearly 14 months of investigations. Goodell emphasized that this commitment to release White’s report was made in front of Congress and the Commanders, and will not be impacted by any sale of the team. The written investigation report is supported by fellow team owner Jerry Jones, regardless of whether it concludes during Snyder’s ownership tenure.

Sale Complicates Legal Resolution

The sale of the Washington Commanders presents significant financial hurdles for prospective NFL owners. One hurdle is being able to fund 30% of the purchase price. Four bidders are currently in contention to buy the team for $6 billion, including Josh Harris, Steve Apostolopoulos, Tilman Fertitta, and a mystery bidder. Michael Jordan is not attached to any bids for the Washington Commanders.

However, Snyder’s demand for indemnification against future liability and legal costs may complicate legal resolution. Additionally, Snyder wants to sell the team, and fellow owners and the league office want him to sell as well. Nonetheless, the NFL team owners have been encouraged not to speak out on Snyder in the media during the sales process.

Mary Jo White’s Report May Change if Sale Occurs

While Mary Jo White is an independent investigator, there is speculation about her impartiality since she has a history of giving the NFL what they want and when they want it. As such, her report is seen as both a carrot and a stick. If Snyder sells, White will conclude that all is well with regards to the allegations against him and his team executives. However, if Snyder keeps the team, White will drop the hammer on him.

Overall, the sale of Washington Commanders football team presents several unique challenges, namely related to potential legal resolutions surrounding workplace misconduct allegations. However, regardless of any potential sale, Mary Jo White’s investigation findings will be released to the public in due course.
